I regret that I am unable to trace in any of these documents or public statements any re- -linquishment by China of her right to claim allegiance over individu- -als who were previously her subjects or any assumption of such right by Great Britain. I am therefore forced to the conclusion (though I am aware that there are others who are of a different opinion) that Chinese in this class are subjects of China only.
Fourthly there are those of Chinese race who were born
in Hongkong, Kowloon or the New Territories after the dates of trans- -fer. I am of opinion that these are natural born British subjects but that by virtue of Article 1 of the newly published Chinese Nation- -ality Laws they are also Chinese subjects.
Fifthly there are those of Chinese race who have be- -come naturalized British subjects. I am of opinion that these persons have a dual nationality unless or until they have complied with the provisions of Chapters III or V (as the case may be) of the Chinese nationality laws. In which case they would be British subjects only.
Sixthly there is the case of the children of naturalis- -ed British subjects born outside the King's Dominions. I am of opinion that Hongkong naturalization confers no consequential naturalization on the children and I know that His Honour the Chief Justice (an expert on Nationality) is of the same opinion. Therefore if such children are born to a naturalized British subject who has not obtained permission to abandon his Chinese nationality under Chapters III or V of the Chinese Law, they are Chinese subjects by virtue of Article I. If their naturalized fathers have obtained such permission then their nationality would I think depend on the place of birth, al- -though they do not quite come within the terms of Article 2. In the case of naturalization in the United Kingdom there is, subject to certain conditions/and consequential naturalization of children (33 Vict. Ch. 14 Sec. 10 (5) ); but I do not think that there are
